This program will address the intersection of Ponzi schemes and bankruptcy cases. The webinar will cover, among other things, what constitutes a Ponzi scheme for purposes of Chapter 11, the Ponzi scheme presumption, and recent attempts by parties to obtain a determination that a bankruptcy case emanates from a Ponzi scheme. We will also highlight the perils and pitfalls of managing a Ponzi scheme Chapter 11 case and provide practical pointers on steps that can be taken to successfully confirm a Chapter 11 plan.
