Cole Schotz Secures Favorable Exclusion Order for OnAsset in Patent Trial
Cole Schotz P.C. successfully defended OnAsset Intelligence Inc. at the International Trade Commission in Washington D.C. against a patent assertion brought by Zebra Technologies Corporation when Chief Judge Cheney issued his Initial Determination in this matter on September 16, 2022. After a year-long dispute, the Cole Schotz team, led by Gary Sorden, secured a complete defense victory.
The investigation was based on a July 28, 2021, complaint filed by Zebra Technologies which accused OnAsset of infringing on two of their communications technology patents. Zebra Technologies, a publicly traded company, sought to block imports of OnAsset’s radio frequency transmission devices used to track cargo, which it sells to customers.
Chief Judge Cheney denied all relief requested by Zebra in favor of OnAsset at the International Trade Commission, determining that that a violation of section 337 of the Tariff Act of 1930 did not occur in the importation and sale within the United States of OnAsset’s radio frequency transmission devices. The Initial Determination will now be reviewed by the Commission. The Initial Determination, if it is affirmed by the Commission, will resolve this matter at the ITC in favor of OnAsset unless Zebra Technologies appeals the decision to the Federal Circuit.
